ASHTON GLENN HOMEOWNERS ASSOCIATION, INC.

                                                                                                                                                           

 

RULES AS ESTABLISHED BY THE BOARD OF DIRECTORS
 

The Board of Directors has established rules governing the use of the common property and facilities and the personal conduct of the members and their guests as authorized under Article IV, Section 4.12 of the By-Laws.

 

General Rules

·        Each homeowner is responsible for informing the Association of his/her current mailing address.

·        The non-residing homeowner who leases his/her Ashton Glenn house to others is required to:

a.       Provide the Association with the name and contact number of the rental agent

b.      Provide the tenants with a set of Rules, Restrictions and Covenants

·        Tenants and visitors, in addition to homeowners, are required to abide by the Rules, Restrictions and Covenants of the Association.

·        Homeowners are ultimately responsible for their tenants’ compliance with the Rules, Restrictions and Covenants of the Association.

·        Inoperative and/or derelict vehicles shall not be stored on a lot in view of neighbors.

·        Vehicles shall not be parked on grass areas on individual lots.

 

The clarification of the nature of a commercial vehicle follows:

 

·        Definition of the word commercial: Occupied with or engaged in commerce or work intended for commerce; viewed with regard to profit.

·        A vehicle displaying one or more of the following items (but not limited to) is considered to be a commercial vehicle:

a.       Commercial signage on the exterior of the vehicle (magnetic or painted, also commercial flags) or signage displayed through the windows of the vehicle

b.      Ladders

c.       Scaffolding

d.      Ramps

e.       Toolboxes mounted on the sides of the truck bed

f.        Toolboxes or compartments built into the sides of the vehicle

g.       Hydraulic or mechanical lift

h.       Crane

i.         Hand truck or dolly

j.        Tanks

k.      Lawn equipment or other mechanical/electrical equipment routinely utilized in commercial activity

l.         Supplies used in commercial activity

m.     Specialty containers used for storage of supplies used in commercial activity

 

The Board of Directors has the authority to render a decision on determining whether a vehicle is a commercial vehicle on a case-by-case basis, and whenever the case is in dispute.


Rules for Common Areas/Conduct of Members

·        PETS:

a.       Owners are responsible for picking up after their animal’s excrement.
b.      Homeowners will be responsible for household pets.
c.       Aggressive animals must be controlled by owners at all times.               

·        No activity which may create erosion or siltation problems shall be undertaken on any lot without the prior written approval of the ACC and the Drainage Committee.

·        Open burning of debris including, but not limited to, rubbish, garbage, leaves

and construction material is prohibited.

 

Rules for Resident’s Conduct at Meetings

·        Annual and Special Meetings shall be conducted according to Roberts Rules of Order.

·        Residents shall conduct themselves with courtesy and decorum toward Board members, residents and guests.

·        Any person displaying disruptive, hostile, offensive or verbally assaultive behavior shall be considered out of order by the Chair of the meeting.

·        Continued disruptive behavior shall be cause for the offender to be asked to cease and leave the meeting.

·        Failure to do so shall be cause to call local law enforcement authorities to have the offender removed from the meeting.

 

Rules for Common Lakes

·        Lakes are for the use by residents and invited guests only.

·        No swimming.

·        Persons entering the lakes (in boats or on the shoreline) do so at their own risk.

·        No fuel driven motorized boats allowed (includes boat motors, model boat motors and other motorized watercraft.

·        Storing boats on Association (common) property overnight is prohibited.

·        Trash is not to be discarded in the lakes or on the shoreline.

·        No unauthorized placement of chemicals in the lakes.

·        Ignition of fireworks on the lakes or common property is prohibited.

·        Fishing is allowed (catch and release only).

·        Be alert to poisonous plants, snakes and other wildlife that may inhabit the

lakes.


Rules for Swimming Pool

These rules are in addition to those required by the South Carolina Department of Health & Environmental Control.

 

·        Facility hours are 9:00 a.m. to 10:00 p.m.

·        The facility is for use by residents and invited guests only.

·        Persons in this facility from 10:00 p.m. to 9:00 a.m. without permission are considered to be trespassing.

·        Diving is not allowed.

·        Cannonballing is not permitted.

·        Good judgment is required for the use of floatation devices (floats, rafts, etc.) so as not to interfere with others.

·        Portable radios and tape/CD players shall not disturb others.

·        No pets, bicycles, rollerblades, skateboards or similar wheeled devices are allowed in the facility, with the exception of a baby stroller or wheelchair.

·        Persons using this facility are cautioned that they proceed at their own risk.

·        No child under 13 years old allowed in the pool without parent or adult (18 years of age).

·        Parents are responsible for the actions of their children.

·        Ashton Glenn residents are responsible for the actions of their guests.

·        Residents are encouraged to enforce these rules.

·        The Association must be informed in advance of planned parties and organized group gatherings to ensure accountability for clean-up.  Such social events do not preclude normal facility activities.
